AB 861 (BENNETT) PENDING ACTION ON SENATE FLOOR
Assembly Bill 861 (Bennett), the subleasing bill, remains poised to be soon brought up on the Senate floor.
Recent amendments to AB 861 (Bennett) exempt mobilehome parks owned by non-profit entities from the bill’s provisions. WMA remains opposed and maintains that this is an issue in search of a problem since the proponents have at no time provided concrete examples justifying the need for statewide legislation.

EMOTIONAL SUPPORT ANIMAL BILL ENROLLED TO GOVERNOR
WMA submitted a formal letter to the Governor requesting his signature on the emotional support animal bill, AB 468 (Friedman). Supported by WMA, this consumer protection measure creates a civil penalty for persons who knowingly and fraudulently represent, sell, offer for sale, or attempt to represent, sell, or offer for sale an emotional support animal or identifying equipment, including vests, ID cards, harnesses, or patches as being entitled to the rights and privileges that accorded by law to a service animal. This bill has not yet been sent to the Governor, but it is expected to be delivered this week.
WATER SUBMETERING PENDING ACTION BY THE GOVERNOR
Assembly Bill 1061 (Lee) remains on the Governor’s desk awaiting his action. WMA requested a formal veto of this restrictive water submetering bill. The Governor has until October 10 to sign or veto this legislation. Please click here to view AB 1061 (Lee):

MIA BONTA WINS AD 18 SEAT
Democrat Mia Bonta has won the special election to fill the 18th Assembly District seat vacated by her husband and California’s Attorney General, Rob Bonta. The 18th Assembly District includes the main cities of Alameda, Oakland, and San Leandro.
SECRETARY OF STATE OFFERS BALLOT TRACKING SERVICE
The California Secretary of State now offers a ballot tracking service to allow voters to receive notifications regarding the current status of their election ballot, i.e., when it is mailed, received, and counted. CHANGES COMING TO MOBILEHOME RESIDENCY LAW FOR 2022
Before adjournment, the state legislature will send hundreds of bills to the Governor for his consideration. There are 491 measures currently awaiting action (252 in the Senate, 223 in the Assembly, and 16 budget bills) by this Friday.
This year, we anticipate several changes to the Mobilehome Residency Law (MRL) based upon newly signed laws, including AB 978 (Quirk-Silva).
Civil Code Section 798.15 requires management to either provide all homeowners with a copy of the new Civil Code by February 1 of each year or provide a written notice to all homeowners that there has been a change to the Civil Code and that the homeowner may obtain a copy of that code from management at no charge. Management must also provide a copy of the Rights and Responsibilities notices by February 1 of each year.
While it is at the discretion of each community to provide either a copy of the new law or a notice that there has been a change(s), we do recommend that all community owners and managers have sufficient 2022 Civil Codes ready for the coming year so that they can be attached to, and made part of, all new rental agreements entered into in 2022.
